4. This communication was followed by a circular

letter from the Crown Agents, dated the 26th May, informing each of

us that "the Hong Kong Government has now decided that the prospective

pension (or dollar portion of pension) registered in your name will

continue to be eligible for payment at the privileged rate of con-

Тейлоги version of 3s. to the dollar". I enclose a copy of this letter.

very unsatisfactory.

5. The wording of this communication appeared to us

The word "eligible" normally suggests a

further act of choice or discretion, but we noted the word "continue",

which we thought must mean

continue as before the financial resolu-

tion of the 1st June, 1938" and in any case we relied on the Secretary

of State's decision as communicated in the letter of the 22nd March.

As, however, we were naturally anxious to make quite sure that the

matter would be put on a proper basis, and that the financial resolu-

tion of the 1st June, 1938, would be rescinded, and the full effect of

the financial resolution of the 7th August, 1902, be restored, Mr.E.R.

Hallifax wrote to the Colonial Secretary a letter, dated the 4th June,

I also enclose a copy of the reply

of which I enclose a copy.

which he received, dated the 4th July, and of the copy of the financial

mels. Resolution of the 29th June which was enclosed.
